Mental Capacity Act

The Mental Capacity Act 2005 is a profoundly important piece of legislation. It is not just concerned with setting out the legal rules that must be applied when a person is assessed as being mentally incapable of making a particular decision; it also provides the mentally capable with the means to plan ahead for a time when they might lack the capacity to make decisions for themselves.
